MEDIACONNECT is the publisher of a platform for the online distribution of press releases and corporate communications issued by companies and institutions, intended for the media and the general public, accessible at: www.mediaconnect.com (the "Platform").
1. Scope of these terms and conditions of use
These terms and conditions of use (the "T&C") apply to your use of the Platform and its content.
By using the Platform, you agree to be bound by these T&C and to read the Privacy Policy.
We reserve the right to modify or to update these T&C and our Privacy Policy at any time. Please check them on a regular basis as any modification thereto becomes effective upon publication on the Platform.
Some features of the Platform (such as the content sharing features, players or embedded social media feeds) are integrated into the Platform but operated by third parties. When using these features on or from the Platform, you undertake to do so in strict compliance with the terms of use applicable to such features.
2. Ownership of the Platform and its content
The Platform, all its components, and the content (whatever its form and nature: press releases, photos, videos, texts, still and animated graphics, trademarks, logos, etc.) available on the Platform (the "Content"), are the exclusive property of MEDIACONNECT, its partners and the issuers of the press releases and other corporate communications made available on the Platform and are protected by intellectual property laws.
You are only authorized to use the Platform and the Content as expressly authorized herein.
3. Terms of use of the Platform and the Content
The Content available on the Platform is displayed as provided to MEDIACONNECT by and under the sole responsibility of the issuer of such Content (who is identified within each piece of Content), and is in no way controlled or overseen by MEDIACONNECT. Consequently, MEDIACONNECT cannot guarantee that the Content available on the Platform is accurate, complete, adequate or compliant with applicable laws and regulations and MEDIACONNECT shall in no event be held liable to this respect.
You shall be responsible for making your own verification and assessment of the Content and shall be solely responsible for the consequences of any decision made or transaction carried out on the basis of any Content available on the Platform.
If you notice any Content that is inaccurate or contrary to applicable laws or regulations, you must report it to MEDIACONNECT so that such Content may, if appropriate, be corrected by its issuer or removed from the Platform.
You are authorized to consult and share extracts of the Content and/or the Platform for strictly personal, private and non-commercial purposes only, and only as made possible by the features available on the Platform.
Any other use, in particular any reproduction, communication to the public or distribution of the Platform and/or the Content, in whole or in part, by any other means, in any other manner and/or for any other purpose than those expressly authorized in these T&C is strictly prohibited.
4. Warranties
You hereby warrant and represent that you will use the Platform, its features and the Content in strict compliance with these T&C and the applicable laws and regulations. You hereby undertake to defend, indemnify and hold harmless MEDIACONNECT (and, where applicable, its partners and the issuers of the Content), from and against all expenses (including attorneys fees and litigation expenses), costs, losses, disbursements, damages, liabilities, arising out of or in connection with any claim, demand, action, proceeding, directly or indirectly resulting from or based on a breach by you of this warranty.
5. Limitation and disclaimers on liability
Although MEDIACONNECT endeavours to provide accurate and reliable Content on the Platform, errors, inaccuracies or omissions cannot be completely ruled out. The Platform, its features and the Content are provided "as is", and you use them at your own risk and under your full and sole responsibility.
The access to or the availability of all or part of the Platform, its features and the Content may be interrupted or slowed down for maintenance operations or for causes beyond MEDIACONNECT's control (in particular, and without limitation, in case of interruption, failure, malfunction, saturation of electricity networks, IT services or telecommunications networks).
MEDIACONNECT reserves the right to modify, suspend, interrupt or restrict the access to or the availability of all or part of the Platform, its features and the Content, at any time.
MEDIACONNECT cannot guarantee that the Platform, its features and the Content are provided free from errors or any breach of security due to hackings, security intrusions, bugs, viruses, malwares, etc., that may affect your hardware, software or data.
In no event shall MEDIACONNECT be liable for any damages whatsoever arising out of or related to the access to or use of, or the impossibility to access or use the Platform, its features or the Content.
MEDIACONNECT is not responsible for third party’s websites that may be referenced on the Platform or referencing the Platform (in particular by means of a hyperlink). References made to third party’s websites on the Platform shall by no means be construed as an endorsement by MEDIACONNECT of these websites or their content. Third party’s websites and their content are governed by their own terms of use.
6. Trademarks and logos
The names, trademarks and logos appearing on the Platform are the exclusive property of MEDIACONNECT, its partners and the issuers of the Content. They may only be used, in whole or in part, with the prior express approval and in strict compliance with the graphic charter of their owners.
7. Applicable law and jurisdiction
These T&C and any dispute arising thereof shall be governed by and construed in accordance with French law.
The Courts of Paris (France) shall have exclusive jurisdiction notwithstanding any actions in warranty or plurality of defendants.
8. Severability
If one or more provisions of these T&C are held to be invalid, illegal or unenforceable under any applicable law or rule, or declared invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision of these T&C, which shall remain in full force and effect.
